ERISA in the Courts: Developments in Fiduciary Litigation

Jamie Fleckner, a partner in Goodwin Procter’s Litigation Department and Chair of its ERISA Litigation Practice, will provide an update of key developments concerning ERISA fiduciary litigation. The presentation will address recent appellate decisions and trends in ERISA class action litigation involving alleged fiduciary breaches and prohibited transactions. The cases to be addressed will include litigation challenging fees paid by benefit plans and plan participants; investment options made available in defined contribution plans, including the use of company stock, mutual funds, and stable value funds; and alleged self-dealing through use of “retained assets” in group life insurance contracts.
