32 Since 2015, three states—Massachusetts, New York and Florida—have represented nearly 50% of all state enforcement actions taken, solidifying their role as spearheading the state enforcement trend. Massachusetts led or had a significant role in nearly 20% of all enforcement matters during this time period. New York (18%) and Florida (12%) also led or had a significant role in many actions. Goodwin further analyzed the underlying data and determined that Massachusetts brings a higher number of enforcement actions per capita than the other two states. Data also reveals that Massachusetts actions have resulted in a lower average recovery amount than New York and Florida, which possibly suggests Massachusetts’ willingness to bring smaller enforcement actions that other states may forego. 2015 2016 2017 Action Number Adjusted 8) State Actions by State 0 5 10 15 20 25 30 35 40 West Virginia Ohio Illinios Washington Minnestoa Maryland North Carolina District of Columbia Colorado Virginia Mass State Actions California Florida New York Massachuetts 5 5 5 6 6 6 7 8 8 9 10 12 16 27 37 STATE ACTIONS BY STATE
