What started as a legal dispute over allegedly counterfeit vape products has ended, at least for now, with the U.S. Court of Appeals for the Ninth Circuit declaring that products made with hemp-derived Delta-8 THC, the cannabinoid cousin of the better-known Delta-9 THC, are legal. Brett Schuman, a partner in Goodwin‘s Cannabis group, said in a recent interview that the Ninth Circuit’s opinion “turns the world on its head." "California is one of a handful of states that has said Delta-8 is illegal,” Schuman said. These products that AK Futures makes, ‘Cake’-branded Delta-8 vapes, are illegal as a matter of California law.
