In 2016, the class action cases we are monitoring will be decided by the U.S. Supreme Court, which could affect defendants’ ability to defend against cases that potentially create serious risk of exposure in class actions alleging technical violations of consumer protection laws; of course, uncertainty about the composition of the Court makes it difficult to predict outcomes. In addition, the U.S. Court of Appeals for the District of Columbia will take up the issue of the constitutionality of the CFPB.
