Steven Ellis is a partner in Goodwin’s Financial Industry and Consumer Financial Services Litigation practices. Recognized as a Southern California “Super Lawyer,” he has extensive experience in the defense of class action lawsuits in both federal and state courts across the country.

Mr. Ellis has represented prominent financial institutions, insurance companies and other major corporations in cases involving home mortgage loans, credit card processing, loan servicing, money transfers and other financial services. In addition to his Consumer Financial Services work, he has also worked on complex commercial litigation matters and business disputes in arbitrations and in court proceedings at both the trial and appellate levels, defended pharmaceutical companies in product liabilities in state and federal courts and advised clients on compliance with state unclaimed property (“escheat”) laws.

Mr. Ellis maintains an active pro bono practice and has been honored with numerous awards for his work, including the ACLU Foundation of Southern California’s Access to Justice Award, the Pro Bono Advocacy Award and the Wiley W. Manuel Award.

Consumer Financial Services Litigation

Mr. Ellis has represented clients in class actions involving allegations of consumer fraud, unfair business practices, breach of contract and violations of federal and state regulatory statutes (including the Fair Credit Reporting Act (FCRA) and California’s Unfair Competition Law, Business and Professions Code section 17200). His representations include:

  • Defended a large national banking association in a series of nationwide and state class action alleging consumer fraud and violations of consumer protection laws arising out of loan origination practices
  • Defended a large national banking association in civil actions brought by the Los Angeles City Attorney’s Office alleging violations of the municipal code and California Business and Professions Code section 17200 arising out of maintenance and servicing of foreclosed properties
  • Worked with a large national banking association in coordinating national defense and supervising local counsel in actions in California, Washington, Oregon, and other Western states challenging the designation of MERS as mortgagee or beneficiary in deeds of trust
  • Defended a major money transmitter in a series of nationwide class actions alleging consumer fraud and violations of consumer protection laws arising out of advertising and foreign exchange disclosures practices
  • Defended a major insurance company in a nationwide class action challenging consumer disclosures
Appellate Litigation

Mr. Ellis has represented clients in appellate matters in federal and state appellate matters in California and across the country. His representations include:

  • Ewing v. California, 538 U.S. 11 (2003) (constitutional challenge to California’s “three strikes” law)
  • Smiley v. Citibank, 517 U.S. 735 (1996) (interpretation of National Banking Act) (amicus)
  • Big Blue Capital Partners v. ReconTrust Co., 2014 WL 2599625 (9th Cir. 2014) (residential mortgage litigation)
  • Rodriguez v. Hayes, 591 F.3d 1105 (9th Cir. 2010) (immigration)

Commercial Litigation

Mr. Ellis has worked on a variety of complex commercial litigation matters and business disputes in arbitrations and in court proceedings at both the trial and appellate levels, including contract disputes, business torts, trade secrets, media cases and professional liability matters. His representations include:

  • Represented private equity group in contract and tort arbitration and litigation against seller of company
  • Represented major pharmaceutical company and technology company in trade secret matters
  • Represented well known service company in asset purchase dispute
Product Liability Actions

Mr. Ellis has defended major pharmaceutical companies in product liability actions in both state and federal courts across the country, including in MDL proceedings and state court coordinated proceedings. His representations include:

  • Represented a major pharmaceutical company and served as liaison counsel for generic manufacturer defendants in a California JCCP proceeding
  • Defended pharmaceutical companies and supplement provider in a wide range of product liability matters
Professional Experience

Prior to joining Goodwin, Mr. Ellis was a partner in the Los Angeles office of Sidley Austin. From 1992-1993, he was Associate Counsel for the Office of the Iran/Contra Independent Counsel.

Recognition

Mr. Ellis has been recognized as a Southern California "Super Lawyer" (2013-14). Mr. Ellis was the recipient of ACLU Foundation of Southern California’s Access to Justice Award in 2010 for his work challenging the government’s immigration detention policies. He previously received the Foundation’s Criminal Justice Award for his work on an initiative relating to California’s “Three Strikes” law as well as the 2008 Pro Bono Advocacy Award. In addition, Mr. Ellis received the Wiley W. Manuel Award for Pro Bono Legal Services awarded by the Board of Governors of the State Bar of California for his work representing the victims of trade school fraud.

While attending law school, Mr. Ellis was an Articles Editor for the California Law Review.
