SEC Signals Openness To Novel Crypto ETPs (Law360)

The U.S. Securities and Exchange Commission appears to be laying the groundwork to approve increasingly innovative crypto exchange-traded products with a staff statement on disclosure expectations and the recent approval of a novel fund, but experts said the commission's openness comes with a focus on fulsome disclosure. "I think all of the indications from the new SEC just have been that they're going to get to yes with at least a large number of the products on file," said Goodwin partner Jeremy Senderowicz to Law360. The commission may decide to take further steps to standardize the process. While the commission hasn't said anything to that effect, Senderowicz said, "it seems likely that the SEC is going to try to come out with some type of general standard. I think the broad expectation is that they're going to come out with something that is broadly applicable, rather than just approving everything one by one."
