Austin Collier

Austin is an associate in the litigation department at Goodwin. Austin’s legal practice includes representations of a wide variety of clients including financial services, technology and healthcare companies in complex commercial litigation and investigatory matters across all stages of litigation, mediation, arbitration and trials. 

His practice focuses on representing large-cap and public companies in contractual, post-transactional and class action disputes involving claims such as breach of contract, fraud, breach of fiduciary duty, and other business torts. Austin also is experienced in litigating data privacy and cybersecurity claims under the CCPA, TCPA, BIPA, and various other state consumer protection and data privacy laws as well as federal regulations. 

• Representation of a group of underwriters in an international securities dispute regarding an IPO and SPO in the Southern District of New York involving parties in China and the United States
• Representation of digital shipping infrastructure company in contractual dispute and related litigation of misuse of proprietary data in state court and through arbitration
• Representation of a large national bank in a complex multi-district class action litigation alleging violations of the Electronic Funds Transfer Act and state unfair competition laws
• Representations of a nation mortgage company in numerous data breach class action lawsuits consolidated and litigated in federal court against a wide variety of privacy and data security claims
• Representation of a publicly traded electronic payments company in a securities litigation in the Southern District of New York
• Representation of an international AI technology company in a BIPA class action lawsuit in the Southern District of Illinois and a related series of arbitrations 
• Represented medical payment company in post-employment dispute regarding sales commissions 
• In re: HIV Antitrust Litigation, C.A. No. 19-02573-EMC (N.D. Cal.); Member of trial team defending Teva Pharmaceuticals against reverse-payment antitrust claims challenging prior settlement of Hatch Waxman patent litigation brought by Gilead regarding Teva’s generic versions of Viread® (tenofovir), Truvada® (tenofovir/emtricitabine), and Atripla® (tenofovir/emtricitabine/efavirenz). Secured a total defense verdict of no anticompetitive reverse payment and no market power, following six-week N.D. Cal. jury trial seeking damages of $3.8 billion (before mandatory trebling) from defendants Teva and Gilead Sciences
• Representation of pharmaceutical company in to vindicate patent rights in by overcoming adverse FDA rulings and defend patent exclusivity against a competitor 
• Representation of a global investment bank in responding to an international dispute requiring engagement with courts in the Central District of California and the Cayman Islands
• Representation of a private equity firm focused on the healthcare services sector and a portfolio company in a post-closing lawsuit in Delaware state court concerning purported inaccuracies in the representations and warranties in the purchase agreement regarding the company’s financial statements
• Guides clients in a wide range of cybersecurity and privacy incidents to protect clients from malware and cyber criminals as part of his work with Goodwin’s Data Privacy and Cybersecurity group
• Representation of numerous class-action defendants against privacy based allegations under statutes including BIPA and TCPA
