Gabriel B. Ferrante is an associate in Goodwin’s IP Litigation Group. His practice spans pre-suit investigation through trial and appeals. With a special interest in patent litigation, Gabriel has contributed to victories in federal district courts nationwide and at the U.S. Court of Appeals for the Federal Circuit. His practice includes representing both innovators and generics in Hatch-Waxman litigation, as well as manufacturers spanning technologies from medical devices to semi-conductors. With a deep understanding of life-sciences clients and their business, Gabriel also litigates on behalf of pharmaceutical companies and the trade associations representing their interests in complex regulatory disputes around the country. Beyond litigation, Gabriel has advised clients on IP licensing and freedom to operate.
Prior to joining Goodwin, Gabriel served as a law clerk for Judge Pauline Newman of the U.S. Court of Appeals for the Federal Circuit.
Experience
- Co-authored prevailing brief in the Federal Circuit securing a reversal of indefiniteness ruling that invalidated medical device client’s patent portfolio in a precedential opinion. The Federal Circuit’s decision reinstated the invalidated claims, allowing the client to proceed to trial against a major competitor
- Co-authored prevailing brief in the Federal Circuit defending petitioner’s complete victory in inter partes review of a software patent
- Represented patent holder in the U.S. District Court for the District of Massachusetts in patent litigation involving large-molecule migraine therapies. After a 3-week trial, the jury returned a verdict in favor of the patentee, finding all asserted claims valid and willfully infringed and awarding the patentee over $176 million in damages. The case is currently pending on appeal before the Federal Circuit
Professional Activities
Gabriel serves as the Program Chair of the Chemistry & the Law Division of the American Chemical Society. In that role, he organizes educational programming at the intersection of science and law for an audience of practitioners of both disciplines.
