Tom McCarthy has been an associate in the Employment practice at Goodwin since 2021. Tom’s practice focuses on counseling businesses on a wide range of labor and employment law issues, representing employers in employment-related litigation and arbitration, and advising clients on labor- and employment-related issues arising in connection with corporate transactions.

Experience

Tom handles a myriad of labor and employment issues, including those relating to discrimination, wage and hour, restrictive covenants, trade secret misappropriation, whistleblower retaliation, breach of contract, sexual harassment, and the WARN Act. Tom counsels employers with respect to all aspects of employment law, from “day-to-day” issues to more complex, unusual, or high-stakes matters. In that capacity, Tom regularly works with C-suite executives, general counsels, heads of human resources, and other legal and human resources professionals for financial services companies, private equity firms (including frequently dealing with issues involving portfolio company executives), non-profit organizations, and others. He has extensive experience drafting and negotiating executive employment and separation agreements, reviewing employee handbooks, and advising with respect to restrictive covenant agreements, discipline/termination, reductions in force, worker classification, and internal investigations.

Tom regularly represents businesses in employment-related litigation before federal and state court courts, human rights commissions, administrative agencies, arbitration panels, and other alternative dispute resolution bodies. His litigation expertise includes enforcement of non-competition, non-solicitation, and other restrictive covenants, defense of claims alleging discrimination, retaliation, and hostile work environment, and both prosecution and defense of claims arising from complex transactions and other contractual relationships. Tom also regularly advises companies on labor and employment issues arising in connection with complex transactional matters, including mergers and acquisitions, financing events, asset deals, and corporate restructurings.

Tom’s work on behalf of clients includes:

  • Representing a multinational cloud computing and virtualization technology company in its multi-billion-dollar acquisition by a global investment firm
  • Defending a leading multinational investment bank and financial services company in connection with reputationally sensitive discrimination claims brought by former employees*
  • Defending a Dutch public company and owner of the Amsterdam, Brussels and Paris stock exchanges, and various subsidiaries, in connection with a litigation in the S.D.N.Y. brought by the former CEO and minority shareholder of a subsidiary company asserting breach of contract and discriminatory retaliation claims*
  • Representing a leading international management consulting firm in litigation involving fraud and breach of contract claims brought against former executives of an acquired consulting business*
