Magdalin Peña Jimenez

Magdalin Peña Jimenez is an associate in Goodwin’s Intellectual Property Litigation practice who focuses on patent and trade secret disputes, with a particular emphasis on Hatch-Waxman and life sciences litigation. She represents pharmaceutical, technology, and medical device companies in district court litigation and PTAB proceedings, advising clients on complex disputes spanning patents, antitrust, and trade secrets.

Magdalin has experience in all phases of patent litigation, including discovery, motion practice, pretrial proceedings, and trial. She has experience on teams that have obtained favorable outcomes through motion practice and at trials. Magdalin has also advocated in court and traveled abroad to secure client interests. As part of her experience, Magdalin has:

• Represented generic pharmaceutical companies in Hatch-Waxman litigation.
• Represented a data security and cybersecurity firm in patent litigation concerning multi-factor authentication.
• Represented petitioner in multiple IPR proceedings related to brimonidine tartrate eyedrops.

Hatch-Waxman and Life Sciences Litigation

• Represents generic pharmaceutical companies in Hatch-Waxman litigation involving small-molecule therapies and complex patent portfolios.
• Experience includes patent litigation and inter partes review proceedings relating to ophthalmic and pharmaceutical products.
• Works on pharmaceutical antitrust matters involving branded drug products and competition-related claims.

Technology and Cybersecurity Patent Litigation

• Represents technology companies in patent disputes involving cybersecurity and multi-factor authentication technologies.
• Experience includes parallel district court litigation and PTAB proceedings.

Trade Secret and Commercial Litigation

• Represents clients in trade secret disputes involving hardware and advanced technologies.
• Advises companies on protecting proprietary information and responding to complex allegations of misappropriation.
