Emily Weber’s practice focuses on intellectual property and technology-related litigation. Emily has experience in all phases of patent litigation, including pre-suit investigations, claim construction, fact and expert discovery, depositions, dispositive motions, trial preparation, and trial.
Experience
- Served as trial team member in a patent infringement action involving wearable technology, contributing to a successful jury verdict of infringement and willfulness.
- Directed the lead plaintiff’s witness in federal court during a pro bono trial.
- Defended a leading communications company across several cases in defense against a patent assertion entity.
- Defended a large telecommunications company in a patent infringement action, identifying critical chain-of-title defects that resulted in dismissal of the plaintiff’s claims.
- Represented a leading consumer electronics company in a multi-patent infringement action, advocating for and drafting a motion to strike that strengthened the company’s trial posture.
- Defended a leading communications company against a patent assertion entity’s first-to-file fight between the Northern District of California and the Eastern District of Texas.
- Coordinated district court litigation strategy with parallel inter partes review proceedings, achieving institution and subsequent invalidation of challenged claims.
Professional Experience
Prior to joining Goodwin, Emily was an associate in the SF office of Desmarais LLP.
In November 2025, Emily represented a pro bono plaintiff in the Northern District of California against a large hospital network for violating her service animal rights. Emily conducted numerous evidentiary arguments and directed the testimony of the star witness, the plaintiff. Her and her team secured a favorable jury verdict.
During law school, Emily worked at the University of Missouri technology advancement office where she conducted patent prior art searches and assisted in the process of protecting university technology. She also worked with Unified Patents in their efforts to challenge patents in inter partes review. Her work at Unified Patents inspired her own personal research on a data-driven relationship between Article III courts and the Patent Office, culminating in her Missouri Law Review publication. Her research focused on the timeliness of district court stays of litigation in relation to a copending inter partes review filing.
