Benjamin Cox is an associate in the firm's Complex Business Litigation & Dispute Resolution, Financial Industry Litigation and Consumer Financial Services Litigation practices. He joined Goodwin in 2012. His practice primarily involves defending banks, mortgage lenders, loan servicers, and other financial services providers against multi-plaintiff, consumer class and mass actions around the country in both state and federal court, including in multi-district litigation. These cases typically involve claims made on behalf of nationwide classes of borrowers under federal statutes such as the Truth in Lending Act (TILA), the Fair Credit Reporting Act (FCRA), the Fair Debt Collection Practices Act (FDCPA), the Real Estate Settlement Procedure Act (RESPA), the Racketeer Influenced and Corrupt Organizations Act (RICO), fair lending and anti-discrimination statutes such as the Equal Credit Opportunity Act (ECOA), as well as state-law claims under unfair and deceptive trade practices acts, predatory lending statutes, and the common law, most typically for complex contractual and quasi-contractual claims.

Mr. Cox also specializes in the defense of defendants in complex products liability actions including mass torts, coordinated proceedings, and individual cases in state and federal court. Mr. Cox has considerable experience briefing constitutional law issues such as federal preemption and personal jurisdiction on behalf of pharmaceutical manufacturers and in asbestos litigation.

  •  Defeating class certification in a nationwide action filed in the Central District of California, alleging breach of contract and violation of various state consumer protection statutes for failure to honor loan modifications
  • Defeating class certification in the largest multi-district litigation challenging servicer practices under the Home Affordable Modification Program
  • Defending a national bank in a putative nationwide class action pending before the 10th Circuit appealing a decision dismissing RICO and promissory estoppel claims based on allegations of misconduct in the loan modification process
  • Defeating class certification in a nationwide action filed in the District of Columbia, alleging breach of contract and violation of the FDCPA for failure to honor loan modifications
