Patrick J. McCarthy (PJ) is a partner in Goodwin’s IP Litigation practice. Mr. McCarthy is a first chair litigator with particular expertise in handling Section 337 Investigations before the International Trade Commission (ITC). Mr. McCarthy has handled nearly forty investigations. He counsels complainants, respondents, and third parties in investigations across a wide breadth of industries and regarding a variety of legal claims. Mr. McCarthy stays current on all important issues related to 337 Investigations and regularly speaks about all areas of practicing at the Commission.

Mr. McCarthy is also an experienced first chair patent litigator in various district courts. He litigates complex technology disputes from start to finish in a broad range of complex fields, especially in the computer, electronic, and mechanical arts. In June 2021, Mr. McCarthy secured a complete jury verdict for his clients that resulted in national Litigator of the Week recognition. The jury found all patents not infringed and all patents invalid. Mr. McCarthy has also argued at the Federal Circuit.

  • Ultravision v. Shenzhen Absen Optoelectronic Co., LTD. and Absen, Inc.: Lead counsel for defendants in an eight-patent litigation. The case went to trial in June 2021 and a jury found all patents that remained for trial were both not infringed and invalid. It was a complete win that garnered national Litigator of the Week recognition.
  • Certain Robotic Vacuum Cleaning Devices and Components Thereof Such as Spare Parts, ITC Inv. No. 337-TA-1057: First chair trial attorney, delivered opening statement at trial.*
  • Certain Modular Led Display Panels and Components Thereof, ITC Inv. No. 337-TA-1114: Lead respondent counsel in Section 337 Investigation until complainant dropped allegations in their entirety prior to trial.
