Mark Raffman concentrates his practice on complex product liability and consumer products litigation and advice (including silica, building products, and wired or wireless technologies in the consumer products, automotive, real estate, and other industries). He advises on regulatory compliance audits and legislation, as well as transactions and investigations concerning product liability, data security/privacy, and other risks associated with the Internet of Things and the COVID-19 pandemic. He has 30 years of experience defending complex litigation matters in state and federal courts nationwide, is a member of the Defense Research Institute, and has lectured and published on a broad range of topics including autonomous vehicles and smart cities.

Mr. Raffman has been recognized as a Client Service All-Star by BTI Consulting Group, based on interviews with general counsel at large and Fortune 100 companies. He has also been selected for inclusion in Chambers USA: America’s Leading Lawyers for Business and The Legal 500 U.S.





On litigation and arbitration matters, representative clients include Continental Building Products, Inc. (product liability and commercial litigation); Robert Bosch Tool Company (product liability counseling); Lafarge North America Inc. (product liability, mass tort, and complex commercial litigation and arbitration); Icynene Corporation (product liability); Pangborn Corporation (product liability and insurance matters); and CNA Insurance Companies (insurance coverage litigation). Mr. Raffman’s recent representations include:

  • A major cement manufacturing company in maritime mass tort litigation alleging that a breakaway barge caused floodwall breaches during Hurricane Katrina resulting in massive flooding of the New Orleans area, resulting in a defense verdict.
  • A major health insurance company in class action litigation involving allegations of consumer fraud in connection with its managed care products, resulting in denial of class certification and a favorable settlement of individual claims.
  • A large building products manufacturer in class action litigation involving allegations that the company marketed defective Chinese-manufactured drywall, resulting in a dismissal with prejudice.
  • Multiple building products companies as national coordinating counsel for product liability and mass tort matters and in connection with advising on potential transactions.
Professional Activities

Mr. Raffman is a member of Litigation Counsel of America. He is also a member of the Defense Research Institute.


In 2011 and 2013, The BTI Consulting Group Inc. recognized Mr. Raffman as a BTI Client Service All-Star based on interviews with more than 300 general counsel at large and Fortune 1000 organizations. He was noted for his client focus, solid legal skills and the ability to demonstrate an exceptional understanding of clients' business, produce outstanding results and reduce costs. Mr. Raffman has also been selected for inclusion in Chambers USAAmerica's Leading Lawyers for Business. While in law school, he served as Supreme Court Note Editor on the Harvard Law Review.
