Last week, the New Mexico Senate passed a bill that would amend New Mexico’s existing automatic substitution law for small molecule drugs to allow “a pharmacist to dispense any one of the … interchangeable biological products that satisfied the final determinations so recognized and listed by the federal department of health and human services and is sold at a lower cost than the … biological product listed in the prescription.” The bill passed the Senate by a vote of 39-0.
Yesterday, the House companion bill was reported out of the House Business & Industry Committee with a “Do Pass” recommendation. The bill has been placed on the Temporary Calendar for floor consideration by the whole House.
