HHS Sets Timeline to End COVID-19 Emergency Use Authorizations
On June 30, 2026, the U.S. Department of Health and Human Services (HHS) announced that COVID-19 Emergency Use Authorization (EUA) declarations will terminate on December 26, 2026, for medical devices and on June 29, 2027, for drugs and biological products.
The declarations were established to facilitate access to unapproved medical products during the pandemic. HHS stated that they are no longer necessary because FDA-approved COVID-19 treatments are now broadly available. Manufacturers of products currently distributed under an EUA will need to pursue approval through standard FDA regulatory pathways. HHS said the transition periods are intended to provide companies sufficient time to seek full approval.
HHS states that it will publish notices of the terminations in the Federal Register.
