Goodwin Procter client Invensys, a leading supplier of automation software and equipment, recently won an arbitration decision following a dispute with See Plus, a former distributor for the company.
See Plus had brought a claim seeking more than $6 million in damages, alleging Invensys had improperly terminated its distributorship. Invensys countered and requested $800,000 in reimbursement for a product it had shipped to See Plus but for which it was never paid.
After two days of arbitration, the judge issued an Interim Award finding that neither party should recover damages because See Plus could not prove its legal claims and Invensys had already recovered See Plus’ debt. In addition, the judge initially declared that See Plus was the prevailing party and was entitled to attorneys’ fees and costs
But, Invensys contested that finding and persuaded the judge that his prior ruling was in error. The Final Award established that Invensys had defeated each of See Plus’ legal claims.
