Kelly Grosshuesch is an associate in Goodwin’s IP Litigation group who focuses her practice on representing clients in intellectual property litigation, including patent and trade secret matters. Kelly’s experience includes advising clients in all stages of litigation from pre-suit investigation through trial. She also represents clients before the Patent Trial and Appeal Board (PTAB) in post-grant proceedings such as inter partes reviews (IPRs). Kelly’s experience covers a range of technologies, including LED display technology and AI virtual assistant technology. Her experience also includes representing life science companies in litigation under the Hatch-Waxman Act and the Biologics Price Competition and Innovation Act (BPCIA).

Experience

Kelly has been involved in various stages of patent litigation, including discovery, motion practice, and pretrial proceedings. Some of her recent engagements include:

  • Ultravision v. Shenzhen Absen Optoelectronic Co., LTD. and Absen, Inc.: Representing Absen in a long-running dispute involving LED display technology.
  • PRCM Advisers LLC et al. v. Two Harbors Investment Corp., (S.D.N.Y.): Representing Two Harbors Investment Corp. against claims of trade secret misappropriation related to various business applications and software. 
  • Nike, Inc. v. New Balance Athletics, Inc. (D. Mass.): Representing New Balance in a patent infringement lawsuit adverse to Nike concerning textile uppers for footwear in the District of Massachusetts and related inter partes review proceedings. 
  • Representing a multinational electronic company in patent infringement dispute in the Eastern District of Texas regarding monitoring a mobile station’s presence in a certain area.

Professional Experience

While in law school, Kelly was a member of the William & Mary Environmental Law and Policy Review. Kelly also undertook a legal internship at the U.S. Department of Veterans Affairs.
