Dobbs Considerations for Employers: Part 1 – Employment and Employee Benefits

Summary

The U.S. Supreme Court decision in Dobbs v. Jackson Women's Health Organization returned authority for regulating abortion to the states. This raises complex legal and ethical issues for employers.

Companies will have to contend with different and often conflicting regulations in each state where they operate. In some cases, state and federal rules may also come into conflict. Issues related to employment and employee benefits have been among the most pressing for companies in the aftermath of the decision.

  • What risks do companies face when employees object to internal statements made (or not) about the Dobbs decision by the company or other employees?
