John Englander is a retired partner and former co-chair of Goodwin’s Litigation Group. An engineer by training, Mr. Englander devotes much of his practice to intellectual property litigation, particularly patent litigation and cases turning on the analysis and description of technology. Most recently, he was lead trial counsel defending Aereo in the landmark copyright case ABC v. Aereo. He also has extensive experience in banking and financial services litigation, with a particular focus on class action defense. Mr. Englander has also litigated cases involving all manner of commercial disputes, business torts and unfair trade practices claims.

He has more than 30 years’ experience, including a clerkship with Justice William H. Rehnquist, and he is annually selected as one of Massachusetts’ top IP litigators by Chambers USA: America’s Leading Lawyers for Business.

  • Teva Pharmaceuticals in Eli Lilly v. TEVA Pharmaceutical, a patent infringement suit involving a chemotherapy agent; 689 F.3d 1368 (Fed. Cir. 2012)
  • Applied Materials in Applied Materials  v. AMEC, in which Applied Materials alleged trade secret misappropriation against AMEC, a Chinese manufacturer of semiconductor equipment; No. C 07-05248 JW, (N.D. Cal.) (settled 2010)
  • ViaCell in PharmaStem v. ViaCell, a patent infringement suit involving the stem cells in umbilical cord blood; 491 F.3d 1342 (Fed. Cir. 2007)

  • Aereo in ABC v. Aereo, a high-profile copyright case brought against Aereo by all the major broadcast television networks now pending in the U.S. Supreme Court (lead trial counsel);  712 F.3d 676 (2nd Cir. 2013)
