Gabriella Montes is an associate in Goodwin’s Intellectual Property Litigation practice who focuses her practice on representing clients in intellectual property litigation, including patent and trade secret matters. Gabriella’s experience covers a range of technologies, including outdoor electronic displays and LED lighting products. Her experience also includes representing life science companies in litigation under the Hatch-Waxman Act and the Biologics Price Competition and Innovation Act (BPCIA).

Experience

Gabriella has experience representing companies in all phases of litigation from pre-suit investigation through trial. Some of her engagements include:

  • Components For Certain Environmentally-Protected Lcd Digital Displays And Products Containing Same, ITC Inv. No. 337-TA-1349. Representing Samsung Electronics Co., Ltd. in asserting patents involving thermal management of outdoor electronic displays.

  • Hoffmann-LaRoche, Inc., et al v. Fresenius Kabi USA, LLC, (D. Del.). Represented Fresenius Kabi as ANDA-defendant in patent litigation involving Genentech’s branded chemotherapy drug Alecensa® (alectinib).  The case settled favorably prior to trial.

  • CAO Lighting, Inc. v. OSRAM Sylvania, Inc. et al., (D. Del.). Representing LEDVANCE LLC against claims of patent infringement related to LED lighting products.

  • PRCM Advisers LLC et al. v. Two Harbors Investment Corp., (S.D.N.Y.). Representing Two Harbors Investment Corp. against claims of trade secret misappropriation.

Pro Bono

Gabriella maintains an active pro bono practice, including representing clients in §1983 actions and various immigration matters. Gabriella worked with the ACLU of Massachusetts (ACLUM) to file a civil rights lawsuit on behalf of the family of Shayne Stilphen for his wrongful death while in the custody of the Boston Police Department.

Professional Experience

Prior to joining Goodwin, Gabriella served as a judicial intern for the Hon. Anthony Cannataro at the New York Supreme Court. She was also a Staff Editor for the New York Law School Law Review Journal.
