2020 Year in Review: Foreign Corrupt Practices Act

The Foreign Corrupt Practices Act (FCPA) impacts every U.S. company that conducts business globally. Investigations, prosecution and punishment under the FCPA is common, with more than $11 billion in fines imposed over the past decade. In 2020, even in the midst of the COVID-19 pandemic and ensuing disruption of business and government activities, it was clear that U.S. regulators remain committed to and focused on aggressive FCPA enforcement against companies, as well as individuals. In this recent webinar, Goodwin partner Jennifer Chunias, joined by Tony Jordan of EY and Kristin Caplice of Bruker Corporation, discussed current enforcement trends and developments, notable judicial challenges and private actions arising out of past FCPA enforcement matters, as well as what companies, boards of directors, and individual managers and executives can expect and plan for in 2021. The panelists also offered practical suggestions for the implementation of effective corporate anti-bribery and anti-corruption programs focused on ethical and compliant behavior and culture.
