Andrea Murino, partner and co-chair of Goodwin’s Antitrust + Competition Law Practice will be a speaker at AHLA's webinar, "Analyzing the Outcome of the Health Insurance Mega-Mergers, Part I: Aetna/Humana Merger." This panel discussion will focus on U.S. District Court Judge John Bates’ Aetna/Humana merger decision. The presenters will discuss the antitrust arguments presented in this case, including both DOJ’s and Aetna/Humana’s arguments about whether traditional Medicare and Medicare Advantage (MA) are separate and distinct markets, whether the Aetna/Humana merger would hinder innovation, and whether the merger would ultimately increase MA premiums. The presenters will also address whether Judge Bates found that the Centers for Medicare & Medicaid Services and state regulators would provide sufficient checks on the Aetna/Humana MA products to ensure continued product enhancements and competitive pricing. The presenters will conclude with how this decision may impact future antitrust enforcement, and what are the next steps in this case.
