Will Evans is an associate in the firm’s Complex Litigation and Dispute Resolution group and a member of its Appellate and Supreme Court Litigation practice. Will’s practice focuses on briefing and arguing critical motions and appeals and on offering strategic litigation advice. He has presented oral argument as lead counsel in a number of successful appeals in both federal and state courts; he also has significant trial experience. His expertise extends across a range of substantive areas, including intellectual property law (particularly trade secret, patent, and copyright issues), securities and commercial disputes, and financial-services litigation. He has also represented pro bono clients in courts across the country, including the U.S. Supreme Court, with a particular focus on immigration and prisoner litigation.
Before joining Goodwin’s Boston office in 2019, Will clerked for Judge Sandra Lynch of the U.S. Court of Appeals for the First Circuit and practiced at Wachtell, Lipton, Rosen & Katz in New York.
Professional Experience
- Drafted the merits briefing in Wilkinson v. Garland, a case from the 2023 Term in which the Supreme Court held that certain “mixed questions” in immigration cases are reviewable in federal court—an important decision keeping the courthouse door open for non-citizens across the country
- Served as the lead appellate attorney for a trial team that secured a landmark jury verdict for Insulet Corporation in a trade secret case against EOFlow, EOFlow’s CEO, Nephria BIO, and three former Insulet executives. Will briefed and argued key legal and evidentiary issues before and during the five-week trial, including the jury instructions and a first-of-its-kind dispute about the proper construction of the federal Defend Trade Secret Act’s statute of limitations. The jury ultimately found that EOFlow and its CEO willfully misappropriated key Insulet trade secrets and awarded $452 million in compensatory and exemplary damages—one of the top trade secret verdicts in the last five years
- Served as lead appellate counsel for a mortgage servicer in a successful defense in the Ninth Circuit of dismissal of a putative class action concerning the company’s online mortgage-payment tools
- Successfully represented a corporate client in precedent-setting en banc proceedings in the Third Circuit concerning dismissal of a putative derivative shareholder suit against the company
- Represented Dr. Reddy’s Laboratories at the trial and appellate levels in a number of patent litigations involving the company’s generic drug products. In a dispute involving Dr. Reddy’s generic of Vimovo®, Will served on a Goodwin team that was hired mid-case and drafted briefing that convinced the district court to reconsider and grant Dr. Reddy’s summary judgment on issue-preclusion grounds.
