Allison M. Funk

An experienced commercial litigator, Allison has represented financial institutions, lenders, and loan servicers in state and federal court as well as before the CFPB and state regulators for more than 15 years. Her practice particularly focuses on data breach and cybersecurity matters, from incident response through class action defense and regulatory investigations.

Allison is an experienced member of the Cybersecurity and Consumer Financial Services Litigation practices. She defends businesses in the wake of cyber incidents, litigating data breach class actions, guiding clients through regulatory investigations and examinations arising from cybersecurity events, and representing companies before the CFPB, state attorneys general, and state financial regulators. Her litigation practice also spans the full range of consumer financial products, including forward and reverse mortgage loans, credit cards, and auto finance, in class and individual suits, enforcement actions, and government investigations.

A trusted adviser, Allison helps clients achieve their legal and business objectives through both litigation and proactive compliance counseling. She regularly advises on data security requirements — including the Gramm-Leach-Bliley Act Safeguards Rule, SEC Regulation S-P, and the NYDFS Cybersecurity Regulation (23 NYCRR Part 500) — and helps companies navigate compliance with state data breach notification laws and state privacy laws, incident response, and regulatory notification obligations. She also counsels clients on state and federal regulations governing the financial services industry, including RESPA, TILA, EFTA, UDAP/UDAAP, and FDCPA.

With artificial intelligence transforming the financial services industry and drawing increasing regulatory attention, Allison counsels clients on the legal, compliance, and litigation risks posed by AI and automated systems — and how to deploy these technologies responsibly.

Allison is a member of the Mortgage Foreclosure Task Force of the New York City Bar Association.

Prior to joining Goodwin, Allison worked for another large international law firm and as legal counsel for the Nassau County Department of Housing and Homeless Services, an administrative agency providing homelessness prevention services with a sizable grant from the U.S. Department of Housing and Urban Development (HUD). Allison worked closely with HUD to develop and implement best practices for disbursement and administration of the grant that were subsequently adopted as models by other agencies.
