Jenevieve Nutovits is an Associate in Goodwin’s Intellectual Property Litigation practice who focuses her practice on intellectual property and complex commercial matters on behalf of life sciences and technology companies. Her practice includes representing clients in patent infringement, trade secret and copyright misappropriation, and licensing disputes covering a wide range of innovative industries, including electronic devices, pharmaceuticals, biotech, and consumer products.

Jenevieve also focuses part of her practice representing life sciences and technology companies in complex, commercial arbitrations, involving licensing, collaboration, and supply agreement disputes. Her experience also includes representing life science companies in litigation under the Hatch-Waxman Act and the Biologics Price Competition and Innovation Act (BPCIA).

EXPERIENCE

Jenevieve has experience representing clients in all stages of litigation and arbitration, from pre-suit investigation through trial and appeal. Some of her recent engagements include: 

  • Representing Recentive Analytics in the first decision by the Federal Circuit on the patentability of machine learning and artificial intelligence inventions
  • Representing New Balance in a patent infringement lawsuit adverse to Nike concerning textile uppers for footwear in the District of Massachusetts and related inter-partes review proceedings
  • Represented MarkForged in a patent infringement lawsuit involving 3D printing technology in the District of Delaware

  • Representing the fashion house Valentino in defense of claims brought by one of its former textile suppliers, Mrinalini Inc., for copyright infringement, trade secret misappropriation, breach of contract, and other related claims. Valentino won an early motion to compel arbitration, staying the district court litigation. Meanwhile, Valentino, represented by both Italian counsel and Goodwin lawyers, had filed a request for arbitration before the Chamber of Arbitration of Milan. Shortly after the court entered the stay pending arbitration, the arbitrator issued an award in Valentino’s favor. Thereafter, Valentino filed a separate U.S. action to enforce the award, which the district court granted and the Second Circuit affirmed. Further proceedings remain pending
  • Represented ETG Fire in an employment trade secret litigation related to special hazards fire protection and complex fire alarms

  • Representing Novartis in an antibody engineering patent license dispute relating to Novartis’s Cosentyx® (secukinumab) and Ilaris® (canakinumab) products and defending cross-claim for payment of post-expiration royalties
  • Represented Novartis in an ITC investigation, related district court litigation, and inter-partes review matters relating to assertion of Novartis pre-filled syringe patent against Regeneron’s EYLEA® (aflibercept) product
  • Represented Dr. Reddy’s Laboratories in Hatch-Waxman litigation relating to naproxen and esomeprazole magnesium

  • Jenevieve has experience in a range of business litigation and arbitration, with a particular focus on disputes for life sciences companies arising under patent licenses, joint development agreements, and supply, manufacturing and quality agreements. Her recent experience includes representing multiple life sciences companies in confidential arbitrations under JAMS and AAA arbitration rules

  • Jenevieve maintains an active pro bono practice, including assisting veterans in VA benefits appeals and representing clients in immigration and asylum matters

Professional Experience

While in law school, Jenevieve was a legal intern in the Health Care Bureau of the New York State Attorney General’s Office. She was a Senior Articles Editor for the Georgetown Law Technology Review and served as the Director of Patents for the Student Intellectual Property Law Association.

Jenevieve is a member of the New York Intellectual Property Law Association (NYIPLA) Patent Litigation and Women in IP Law Committees.
