Partner Jacqueline Klosek, counsel Federica De Santis, and associates Gabe Maldoff, Jacob Lee and Corey Berman write for PLI Plus that as the new federal administration takes shape and the 2025 state legislative session ends in most states, regulation of sensitive data—and health data specifically—is emerging as a key priority. At the federal level, a new rule restricting transactions involving sensitive data and certain countries of concern (such as China) took effect on April 8, 2025, subject to a 90-day delay in enforcement through July 8. The Federal Trade Commission (FTC) has signaled it will assist the Department of Justice (DOJ) in enforcing the rule and will begin enforcing a similar law passed last year affecting data brokers. The FTC is also likely to continue its efforts to curb the sale of health data without consumer consent. Outside the federal arena, states including Virginia, New York, and Montana have advanced bills to expand protections for health data.
