US House Republicans' attempt to strip the duty-of-care provision from the Kids Online Safety Act would significantly alter tech companies' responsibilities under the proposed law and likely make consumer protection suits against the companies much more difficult. A duty of care is the legal obligation to ensure products are safe, and it requires companies to act reasonably to avoid creating harmful products. People are still likely to pursue lawsuits in the area of child safety, however, said Jacqueline Klosek, a partner in Goodwin’s Technology practice. “People are very concerned about the impact of all this time online and certain content, of course, for kids and teens. And I think crafty plaintiffs would come up with novel theories on how to try to pursue this. And we've seen that already. It's not all being brought on the same kind of legal basis. So I think people would continue to be creative and try to address this through litigation where possible,” Klosek said in a recent interview with MLex.
