Jonathan Ishee is a partner in Goodwin’s Private Equity group. Jonathan advises investors, technology companies, and healthcare providers, on mergers and acquisitions, data privacy and security, regulatory requirements, and healthcare information technology. Jonathan’s principal area of practice focuses health law issues including HIPAA, managed care contracting, technology acquisition, creation of health care joint ventures, Medicare Advantage, value-based care and innovative payment models. Jonathan regularly guides clients through the complexities involved with telehealth; emerging healthcare delivery models, digital health and wellness applications, data privacy and security; managed care contracting; state insurance licensing, and the corporate practice of medicine. He assists clients with the creation of HIPAA and HITECH compliance strategies and their incident response plans. Clients across a range of industry sectors also seek Jonathan's advice on international privacy law, including GDPR, and regulations related to artificial intelligence, machine learning, research, and employee data.

Experience

Representative matters include:

  • Advised multiple health care providers and technology companies on regulatory, reimbursement, and operational issues surrounding the provision of telehealth services in all 50 states and internationally*
  • Represented a client in a HIPAA breach involving more than 200,000 individuals*
  • Advised client on the rollout of a digital health and wellness application that uses behavioral modification to increase health outcomes in individuals with IBS and Crohn’s disease*
  • Represented a startup telemedicine provider in connection with a $30+ million sale to a national health care provider*
  • Advised multiple private equity clients in the acquisition of a revenue cycle management companies*
  • Counseled a national fitness company in the creation of a comprehensive HIPAA and HITECH compliance strategy and program in order for it to satisfy its duties as a business associate of a health care organization*
  • Advised an international NGO in the creation and implementation of a GDPR compliance program for EU-based election monitors*
  • Counseled a Formula One team sponsor on issues surrounding the international transfer of employee data between jurisdictions*
  • Advised a physician health organization in the creation of a health information exchange and development of a clinically integrated network*
  • Counseled employers in the retail and technology space on development of employer-based primary care clinics in multiple states and related issues including, licensing, and compliance with other health care specific regulatory requirements*
  • Advised an academic medical center and medical residency program on ACGME accreditation and program related issues*
  • Advised a Federally Qualified Health Center (FQHCs) on compliance with HRSA requirements*
  • Counseled a software developer on regulatory issues surrounding the development of digital health products*
  • Advised an academic medical center on international privacy and biobanking regulations related to a research program involving participants in 15 countries*
  • Represented a technology/insurance startup in licensing proceedings before the Texas Department of Insurance and issuance of a certificate authority for a new large employer group health plan product*

Professional Experience

Before joining Goodwin, Jonathan practiced at several other international law firms, as the general counsel of a large multispecialty physician group and Medicare Advantage independent practice association, and a policy analyst with the Office of the National Coordinator for Health Information Technology.

Jonathan was an associate editor of the IEEE Journal of Translational Engineering in Health and Medicine from 2012 to 2015 and is currently an assistant professor of Biomedical Informatics at the University of Texas-HSC Houston.
