Summary
In between reviewing emergency applications by or against the federal government, the Supreme Court finished its merits decisions and left town for the summer. The Court’s merits docket was lighter than ever, and the Court left several key business cases undecided, while hitting some important issues of administrative and constitutional law. And some harsh words were exchanged about how pro-business the Court really is. Goodwin partners Willy Jay, Jaime Santos, and Brian Burgess in our Supreme Court and Appellate Litigation practice presented on what last term’s decisions signal for the coming battles between businesses, blue states, and the Trump Administration. They discussed how the Court’s most junior Justices (Justice Barrett and Justice Jackson) are changing the dynamics of the Court.
