Goodwin Wins Appellate Victory Restoring Invisalign Patent

The Appellate Litigation team won an appeal for Align Technology, Inc. in a patent dispute case brought by ClearCorrect LLC involving Align’s patent no. 6,699,037, entitled “Method and System for Incrementally Moving Teeth” (the ‘037 Patent). In a unanimous decision, the United States Court of Appeals for the Federal Circuit vacated the Patent Trial and Appeal Board’s (“PTAB”) decision to invalidate four of the patent’s claims as obvious because “[n]either the Board’s decision nor ClearCorrect’s brief on appeal reveals substantial evidence in support of those findings.”
