Goodwin Wins Appellate Victory Restoring Invisalign Patent

The Appellate Litigation team won an appeal for Align Technology, Inc. in a patent dispute case brought by ClearCorrect LLC involving Align’s patent no. 6,699,037, entitled “Method and System for Incrementally Moving Teeth” (the ‘037 Patent). In a unanimous decision, the United States Court of Appeals for the Federal Circuit vacated the Patent Trial and Appeal Board’s (“PTAB”) decision to invalidate four of the patent’s claims as obvious because “[n]either the Board’s decision nor ClearCorrect’s brief on appeal reveals substantial evidence in support of those findings.”

Align Technology designs and manufactures the Invisalign® system, the most advanced clear aligner system in the world, and iTero® intraoral scanners and services. Align’s products help dental professionals achieve the clinical results they expect and deliver effective, cutting-edge dental options to their patients.

Goodwin was retained as appellate counsel after the PTAB decision.  The Goodwin team was led by partner William Jay and associate David Zimmer
